- a brand strategy conversation,
- a sample week of content scripts,
- a free story with a product photo in the brand's style.
- With a free Account, to the extent and within the limits shown in the Service, the Client can also save Brands, make stories and posts from templates, edit texts and photos, use AI-edited product photos, translate texts, make video reels with AI, keep a Schedule and receive files delivered by CosmoMango.
- The Paid Services are Packages (§ 7), Plans (§ 7a) and Reels with an actor (§ 8).
- The brand scan reads only publicly available content of the website named by the Client, respecting its robots.txt file. If the website does not allow automatic reading, the Service may use a Google Search summary prepared by an AI model.
- CosmoMango does not publish content on social networks and does not connect to the Client's social media accounts. The Client downloads and publishes the Materials.
- The Provider may develop, change and withdraw free features and set their limits. This does not affect paid orders.
§ 4.Technical requirements and security
- To use the Service you need a device with internet access, an up-to-date browser (for example Chrome, Safari, Firefox or Edge) with JavaScript and cookies enabled, and, for an Account, an active email address.
- The Service can be installed on a phone or computer as an app (PWA). It works over the internet.
- Using online services carries typical risks such as malware, phishing or a hijacked email account. The Client should keep the device and browser updated, protect access to their email and never share sign-in codes. The Provider never asks for a sign-in code.
- The Provider may interrupt the Service for maintenance, keeping it to the necessary minimum.
§ 5.Use without an account and the Account
- Using the Service without an Account requires no personal data. A Guest's results are linked to the browser with a cookie. They may be unavailable on another device or after clearing browser data.
- An Account is created by entering an email address and the one-time code sent to it. The Service does not use passwords. The Account agreement is concluded at the first sign-in, for an indefinite period, and is free of charge.
- When saving a Brand to an Account, the Client can move to it the Brand and Materials made as a Guest in the same browser.
- The Client is responsible for actions taken with their Account and for the security of their email account. The Client informs the Provider without delay of any suspected unauthorised access.
§ 6.Orders, prices and payments
- Prices are shown in Polish złoty (PLN) as net prices. VAT at 23% is added. Before ordering, the Client sees the price, the scope of the service and the payment method, and the gross amount on the payment page or on the invoice.
- On the date these Terms take effect the prices are: 7-day Package: PLN 999 net, 14-day Package: PLN 1899 net, 30-day Package: PLN 3499 net, Pro Plan: PLN 99 net for 30 days, Studio Plan: PLN 249 net for 30 days, Reel with an actor: PLN 250 net. The current price list is in the Service.
- The Client places an order with the order button (for example "Order 7 days" or "Place the order"). The contract is concluded when the order is confirmed in the Service or by email.
- The Client pays:
- online through Stripe: BLIK, payment card, Przelewy24 or another method shown on the payment page; payments are handled by Stripe Payments Europe, Limited, or
- by bank transfer based on a VAT invoice, by the due date stated on it.
- The Provider issues VAT invoices electronically in accordance with the law, including in the Polish National e-Invoice System (KSeF) where required, and sends them to the Client's email address. The Client provides correct invoice details (company name, tax ID, address) and is responsible for them.
- The Client may cancel an unpaid order at no cost. The Provider may cancel an order not paid by the due date on the invoice, informing the Client.
§ 7.Packages
- A Package covers making Materials for 7, 14 or 30 consecutive days, in the number and types described when ordering (stories, posts and reels, including reels with an actor).
- A Package starts when it is activated, which happens after the payment is received. Delivery of Materials starts within 24 hours of the payment being received.
- Materials appear in the Client's Schedule for the consecutive days of the Package. The Client can review, edit and download them.
- We make the Materials based on the Brand Brain, the Client's website and the Client Content. If recordings need products or photos (the "For the recordings" list), the Client delivers them as described in § 8(2).
- If the Client does not provide the needed products, photos or information, the Provider makes the Materials from the available data or, after agreeing with the Client, moves the delivery date. A delay for this reason is not improper performance.
§ 7a.Plans
- A Plan gives a Client with an Account a pool of Credits and a Brand limit for 30 consecutive days: the Pro Plan is 1000 Credits and 1 Brand, the Studio Plan is 2500 Credits and up to 5 Brands.
- In a Plan the Client makes the Materials themselves with the Service's tools and is responsible for their final form. A Plan does not include the Provider's team's work: recordings with an actor, making Materials for the Client or checking them by a person. Packages (§ 7) include those services.
- A Plan is paid in advance, once, online through Stripe. A Plan does not renew automatically. 3 days before its end the Provider reminds the Client by email.
- A Plan starts when the payment is received. If a Package or another Plan of the Client is running at that time, the new Plan starts after they end.
- If the Client buys a Package during a Plan, the Plan is paused for the Package (the Client then uses the Package's Credits), and the remaining days of the Plan run from the day after the Package ends, with the Plan's full pool of Credits.
- Credits not used during a Plan expire when it ends and cannot be exchanged for money. Materials made during a Plan stay in the Account.
§ 8.Reels with an actor
- A Reel with an actor is a 9:16 video recorded with a real actress or actor in the Provider's studio in Kielce, with the Client's product. The price is PLN 250 net per reel.
- The Client chooses the reel format, the person and the place, or leaves the choice to the Provider, and then:
- sends the product to the address given after ordering, with the order number on the parcel, or
- uploads photos of the product when shipping is impractical (for example for large or expensive items); the actor then films with a similar item and the product is added from the photos.
- The Client approves the script before recording. We film what the Client approved.
- AI may change the background, the place and the look of the person in the reel. The product stays real, as in the recording or the Client's photos. The actor's voice and movements stay real.
- The reel is ready within 3 Working days of the product or photos arriving and the payment being received. It appears in the Schedule on the chosen day or, if that day passes earlier, on the day it is ready.
- The reel price includes one revision (on-screen text, cuts, music). Further changes, or changes beyond the approved script, may be charged after agreement with the Client.
- The Client bears the cost and risk of shipping the product to the Provider. Consumable products (for example cosmetics or food) may be opened or used during filming.
- The Provider keeps the product for 30 days after recording and, at the Client's request, returns it at the Client's cost. If the Client does not ask for its return within that time, the Provider may, after notifying the Client by email 7 days in advance, give the product to charity or dispose of it.
§ 9.Client obligations
- The Client uses the Service in accordance with the law, these Terms and good practice, and provides true information.
- The Client declares that they hold the rights to the Client Content, including copyright, trademark rights and the consent of people to the publication of their image, and that using it in the Service and in the Materials does not infringe third-party rights.
- For a brand scan the Client enters the address of their own website or of the brand on whose behalf they act.
- In particular, it is forbidden to:
- provide unlawful content, including content infringing personal rights, copyright or trademarks, inciting hatred, pornographic content or content showing minors in a sexual context,
- make misleading advertising or content impersonating other people or businesses, including content showing real people without their consent,
- advertise products or services whose advertising is prohibited or restricted by law in a way that breaks those rules,
- circumvent limits, scrape the Service, attempt unauthorised access, test security without the Provider's consent or overload the Service.
- In case of a breach the Provider may refuse to make a Material, remove or block content and, for serious or repeated breaches, suspend the Account, telling the Client the reason.
§ 10.Materials made with AI
- Materials are made with artificial intelligence models and with the Provider's team. They may contain errors, inaccuracies or elements that do not match reality, for example in product details, texts, translations or facts.
- The Client checks every Material before publishing and decides alone whether, where and when to publish it. The Client is responsible for the content of published Materials, including the truthfulness and legality of claims about their products and services.
- The Client decides whether to label Materials as generated or modified with AI, in line with the rules of social networks and the law. The Provider recommends such a label when AI changes the look of people or the place (for example on Instagram: "AI info").
- Client Content is sent to AI model providers only to make the Materials. The Provider does not train AI models on it. Details are in the Privacy Policy.
- AI models may refuse to generate some content. For Paid Services the Provider will then make the Material in another way.
§ 11.Copyright and licences
- The Service software, templates, layouts, sample Materials and the CosmoMango name and marks belong to the Provider or its licensors. The Client may use them only in the Service and as part of the delivered Materials.
- When a Material is delivered, and for Paid Services when the full price is paid, the Provider grants the Client a non-exclusive licence, unlimited in time and territory, to use the Material to market and promote the Client's own business, in the following fields of exploitation:
- recording and reproducing by any technique, including digital,
- storing in computer memory and on networks,
- making available to the public so that anyone can access the Material at a place and time of their choosing, in particular on social networks, on the Client's website and online shop, in newsletters and messaging apps,
- public display and playback, including in paid online advertising,
- making changes, including shortening, cropping, adding captions, translating and combining with other content, and using the Materials so changed.
- The Client may authorise people and businesses acting on their behalf, for example an agency running their profiles, to use the Materials to the same extent. The Client may not resell the Materials or offer them as separate products, for example in stock libraries.
- The licence is non-exclusive because templates, layouts and shared elements are also used in other clients' materials. However, the Provider will not give anyone else a finished Material made for the Client with the Client's product and Brand.
- The Provider ensures that the people appearing in Reels with an actor have consented to the publication of their image to the extent needed to use the Reel under paragraph 2.
- Copyright protection of AI-generated content may be limited. The licence covers the Materials to the extent the Provider holds rights in them.
- The Client grants the Provider a free, non-exclusive licence to use the Client Content as needed to provide the services: storing, copying, processing, including with AI, and including it in Materials, for as long as the services are provided.
- The Provider may show the Client's Materials as examples of its work, for example on the CosmoMango website and social media, only with the Client's prior consent, given for example by email. The consent can be withdrawn at any time with effect for the future.
§ 12.Complaints
- The Client may file a complaint about the services, for example when a Material does not match the order, contains an error or was not delivered on time, by writing to contact@cosmomango.com.
- A complaint should include the Account email address, the order number (if any), a description of the problem and the expected solution.
- The Provider handles the complaint within 14 days of receiving it and replies by email.
- If the complaint is accepted, the Provider, depending on the problem and taking the Client's expectations into account:
- corrects the Material,
- makes it again, or
- refunds part or all of the price for the defective part of the service.
- Changes that result only from the Client changing their mind after approving the script or the Material are not a complaint. They can be done as an additional service.
§ 13.Cancellations and refunds
- An unpaid order can be cancelled at any time at no cost: in the Service where that option exists, or by email.
- The Client may cancel by email a paid Package that has not started and a paid Reel with an actor that has not been recorded yet. The Client then gets a full refund of the amount paid.
- The Client may end a started Package early. The Client then gets a refund proportional to the Package days for which Materials have not been delivered yet. Example: when a 7-day Package ends after Materials for 3 days were delivered, we refund 4/7 of the amount paid.
- The Client may cancel by email a paid Plan that has not started yet or in which no Credits were used. The Client then gets a full refund of the amount paid.
- A Reel with an actor that has already been recorded cannot be cancelled. It will be finished and delivered, and a refund is possible through an accepted complaint (§ 12).
- Refunds are made within 14 days of the request being accepted: for Stripe payments to the same payment method, and for bank transfers to the account the payment came from, unless the Client names another. The Provider issues a corrective invoice.
- If the Provider cannot perform the service, for example for technical reasons or because of content breaching § 9, it refunds the amount for the part not performed.
§ 14.Sole traders with consumer rights
- This paragraph applies to a natural person running a sole proprietorship who concludes a contract directly related to their business, where the contract shows that it is not of a professional nature for them, as follows in particular from the business activity disclosed in CEIDG (Article 38a of the Polish Consumer Rights Act of 30 May 2014).
- Such a person may withdraw from a distance contract without giving a reason within 14 days of concluding it, by sending a statement to contact@cosmomango.com or to the Provider's address. They may use the model withdrawal form in Annex 2 to the Consumer Rights Act, but do not have to. Sending the statement before the deadline is enough.
- If such a person asks for performance to start before the withdrawal period ends, for example by paying for a Package that is then activated or by ordering a Reel to be recorded, and then withdraws, they pay for what was performed up to the withdrawal, in proportion to its scope.
- The right of withdrawal does not apply if the Provider has fully performed the service with the person's express prior consent, after the person was informed before performance started that they would lose the right of withdrawal once the service is fully performed, and acknowledged this.
- The Provider refunds the payment within 14 days of receiving the withdrawal statement, using the same payment method the person used, unless they agree to another method at no cost to them.
- Provisions of these Terms do not apply to such a person to the extent they would conflict with the rules granting them consumer protection, in particular § 15(1), (3) and (4) and § 20(3).
§ 15.Liability
- The Provider's liability to the Client is limited to the amount the Client paid for the service the damage relates to and does not cover lost profits. This limit does not apply to damage caused intentionally.
- The Provider is not liable for:
- the results of publishing on social networks, such as reach, followers or sales,
- decisions of social network operators, such as removing content or blocking an account,
- the Client's decision to publish and the content of published Materials,
- the consequences of the Client breaching § 9, including third-party claims related to the Client Content,
- interruptions and errors caused by force majeure or by third parties the Provider is not responsible for, such as internet providers.
- Free features are provided as they are, with no guarantee of a particular result.
- The Provider's liability under the statutory warranty for defects (rękojmia) is excluded. The Client uses the complaint procedure in § 12.
- The Client indemnifies the Provider against third-party claims arising from the Client Content or from the Client publishing the Materials and covers the reasonable costs of such claims.
§ 16.Processing of personal data on the Client's behalf
- If the Client Content contains personal data for which the Client is the controller (for example images of employees, customers or models, or customer data in texts or files), the Client entrusts the Provider with processing it under this paragraph, which is a data processing agreement within the meaning of Article 28 GDPR.
- The subject matter and purpose of processing is providing the services under these Terms. Processing covers storage, analysis, editing, including with AI, making Materials and making them available to the Client. It lasts until the services end and the data is deleted under paragraph 7.
- The data concerned is image, voice, name, contact details and other data contained in the Client Content. It relates to the Client's employees and associates, customers, models and other people shown in the Client Content. The Client does not entrust special categories of data (Article 9 GDPR) unless necessary and lawful.
- The Provider:
- processes the data only on the Client's documented instructions; these Terms and the Client's actions in the Service are the instructions,
- ensures that people authorised to process the data are bound by confidentiality,
- applies the security measures required by Article 32 GDPR,
- assists the Client in meeting obligations towards data subjects and under Articles 32-36 GDPR, as far as the nature of processing allows,
- notifies the Client of a personal data breach without undue delay, no later than 48 hours after discovering it,
- makes available to the Client the information needed to demonstrate compliance and allows audits with at least 14 days' notice, no more than once a year unless there has been a breach.
- The Client gives general authorisation for sub-processing by the providers listed in the Privacy Policy (including hosting, AI models and email). The Provider gives at least 14 days' notice of intended changes by updating the Privacy Policy and emailing Clients with an Account. The Client may object and terminate the contract. The Provider imposes the same data protection obligations on sub-processors and transfers data outside the EEA only with the safeguards of Chapter V GDPR.
- The Client declares that they have a legal basis to process and entrust the data, including consents to publish people's images where required.
- After the Account is deleted or the services end, the Provider deletes the entrusted data within 30 days, unless the law requires further storage. Backups are overwritten within a further 30 days. Before the Account is deleted, the Client can download their Materials.
§ 17.Reporting illegal content
- The single point of contact for Member State authorities, the European Commission and users under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act) is contact@cosmomango.com. You can contact us in Polish or English.
- Anyone can report content stored in the Service that they consider illegal by writing to this address. The notice should explain why the content is illegal, say where it is, give the name and email of the person reporting it (with the exceptions provided in the Digital Services Act) and state that it is made in good faith and the information is accurate and complete.
- The Provider confirms receipt of the notice, handles it without undue delay and informs the person reporting it of the decision.
- If the Provider removes or blocks content or restricts access to an Account, it informs the Client of the decision and the reasons. The Client may appeal by email; we handle appeals within 14 days. The Client may also go to court.
§ 18.Termination
- The Client may stop using the Service at any time and ask for the Account to be deleted by writing from the Account email address to contact@cosmomango.com. Paid orders are settled under § 13.
- The Provider may terminate the Account agreement for important reasons, for example closing the Service, with 14 days' notice, and with immediate effect if the Client seriously or repeatedly breaches these Terms.
- Before the Account is deleted, the Client can download their Materials.
§ 19.Changes to the Terms
- The Provider may change these Terms for important reasons, such as changes in the law, in the scope or manner of providing the services, prices, payment methods or security requirements.
- The Provider announces changes at least 14 days before they take effect: by email to Clients with an Account and in the Service for everyone. A Client who does not accept the changes may terminate the contract under § 18 before they take effect.
- Orders placed before a change remain under the previous Terms.
§ 20.Final provisions
- These Terms and the contracts concluded under them are governed by Polish law. Matters not covered here are governed in particular by the Polish Civil Code, the Act on providing services by electronic means, the GDPR and, for sole traders with consumer rights, the Consumer Rights Act.
- The Polish version of these Terms is binding. The English version is a translation.
- Disputes with Clients are resolved by the common court competent for the Provider's registered place of business.
- These Terms are effective from 10 October 2026, and § 7a (Plans) from 20 October 2026.
